So a couple days ago a girl signed up at my boards, because she saw her brother on it and I guess wanted to join as well. She started doing some triple and quadruple posting, so I assumed it was her first forum and when another member posted this new member was his sister I asked him how old she was, over private messenger, and he informed me she was twelve. I asked him how much longer until she was thirteen, and it turns out not until December. Now, I do have the coppa form up and did beforehand, so obviously she went around it, and I have temporarily suspended her until her birthday in December 2008, but what I want to know is if there's anything I can do to offer this girl so I can still allow her on the forum without worrying about breaking the IF ToS? E.g. could I ask her to get her parents to email me with their permission and a coppa form and remove the suspension without worrying about breaking the ToS? I only really want a response from a mod or admin who know what they're talking about, not interested in user support. Thanks. |

Unfortunately, there is nothing you can do. The ToS is strict against users under 13, and the account(s) must be deleted:
From the ToS. I know I'm not an mod or admin as you requested, but too many times has this question been posted, and many of the support members have this memorized. |

Unless they fill in the COPPA you will need to delete her account. Suspending it will not do. Until she is 13 she can not have an account without parental permission in the form of COPPA. |

I believe that is based on administrators under 13, not forum members.
Hence why I didn't really want user support. I don't like being told different things by people who can't speak on behalf of the site.
I don't comprehend that, what difference would it be to have a suspended account or no account? Shouldn't I give her the chance to fill in the coppa form before just deleting it? Whatever, I'm deleting it to avoid trouble, but I think that's silly to put it nicely. |

It is illegal to have a member under 13 on your site without a COPPA form. It is not an InvisionFree rule, it is a law. By suspending, she is still a member. You have to delete the account to comply fully with the law. |

The reason why it has to be deleted is because you can't store information from users under the age of 13. To get an account at any forum requires the user to submit an e-mail address which falls under personal information and hence why you can't let this user have an account until they are 13 years old or have filled out and submitted a coppa form via snail mail or fax. |

A person under 13 cannot use the forums without COPPA. The person also cannot own a board. A lesson here is that if you are not mature enough to even be able to hide your true age, then you should not be using Internet message boards. |

Yay for 2 people posting the exact same thing over in different words, who can't seem to read thread titles.
I already said I deleted the account as of my last post. I just think how the law goes about it is ridiculous.
You turn it on through admin cp and then go to registration and there'll be a link.
Or because they realize they'll be deleted off a forum they're interested in joining for a slightly idiotic law and rather just get around it by pretending their a year older. I'm sure you'd feel differently if you were twelve trying to get onto a forum. Age is a minor reflection of maturity. Mods, just close this please. Thanks for answering Kezzie. |

We are well aware that the law is both ridiculous and impossible to enforce effectively. However, since it is the law, InvisionFree must obey it or otherwise be held liable. The government can and has fined services for not complying or enforcing COPPA. |
