If you are talking to me PhranK, then the reason I was given by Brian, for my board being closed was that one of my members had spammed the link to my board on another chat room/ forum.

I have spoken to this member and she has admitted to posting it a couple of times.
She has promised not to do it again and if she does then I will suspend her (assuming my board does get re-opened like Brian said it should) :)

I hate putting it this way, but in some ways it is true (my friend said this once):

"When you accept the TOS, you are practically signing over your 1st Amedment rights."

Not 100% accurate, but you should get the general concept.  Also, I'm pretty sure this "reference" only applies to citizens of the United States.  The biggie, though, is freedom of speech.  The TOS states you can't post pornography, use excessive profanity, etc...which all has to do with freedom of speech.  When you register a new board, you're agreeing that you won't do those things which is, in a way, your saying you understand that your right to freedom of speech is limited.  This is mostly due to each board being publicly viewable.

We are not a government organization thus there are no first amendment rights to start with. We do have a self enforced freedom of speech type policy. We will not remove anything from a board because it conflicts with our opinions.

No, either we would reopen your board or we would never reopen it.

well, can the forum I mentioned earlier be re-opened If I take care of the TOS problem. What was it by the way

Please reopen http://s6.invisionfree.com/FF_Stuff/; our staff worked hard and sacrificed a lot for those forums. Sephiros spent so much time and effort that he failed two classes. The offender has been taken care of. His attack ended weeks ago. It will NEVER happen again and that was only one person. Our staff will do their best to prevent something like this from ever happening. One of the root admins made a vital notice to all mods, super mods, and admins about modding the forums. Please give us a second chance and reopen the forums.

Firstly, let me assure the admins I have no ill intentions in posting this message under an alternate account. I am in fact JimmyNZ, that username has for some reason been disabled for 2 weeks from these support forums.

However... I was not about to sit idly and allow potentially misleading information be posted without informing everybody of my side of the story.

Let me assure you I am not at all debating the TOS. And thank you Duffman for actually taking the time to repsond. Honestly I wasn't expecting anybody to throw me a bone.

What Duffman states about Pornography on SPNZ is true for the most part, but it's not 100% accurate, or representative of what's really on (or not on) my board.

The fact is, when my forum was shut down, there was no such limited access section on my forum. Duffman hasn't omitted you this detail.

To cut a long story short, this is what has happened on my forum in the last few days...

1. One of my users changed his avatar to something pornographic, & posted some pornographic pictures.
2. I removed the avatar and the pics. I then stated (not realising it at the time) "Do you want an R18 section?", to which he said yes.
3. I check the TOS. No pornography. So I remove the R18 section, and the pictures that said user had posted.
4. I post a message that in a nutshell says... "Porn is against the TOS, do you still want to go ahead and risk it? or play it safe?"
5. SPNZ is closed.

Now that does still incriminate me as such. I know this. Yes I was expressing the possibility to break the TOS. I know this.

What I also know is that when my forum was closed... there was no such limited access section or offensive material on my forum. Only the message I posted. My intention by this was to give my users the chance to express thier views. Being that only 1 user wanted an R18 section, I expected the rest to say "no way! no r18 stuff!".

Unfortunately, this message I posted, appears to have been interpreted as "reason enough" to close my forum. Fine. I'm not disputing this, even though I do disagree with it. However Duffman you are inaccurate in stating there was a limited access section, as you know and I know... that at the time of closing, there wasn't.

So that's it, that's my side of the story. I just wanted you to know the details that Duffman hasn't omitted to you. Should this message be deleted... being that this is an alternate account. I will repost it at some stage until I am satisfied that the right people have read it.

However, I would urge IF admins to leave this message be as telling my side of the story here has been my only goal in posting. Delete the alternate account if you like... but please leave the message be. It will be soon forgotten anyway.

Too bad at least part of that is a flat out lie.
I was one of the staff who visited your site to investigate complaints.
I saw the porn topic you refer to firsthand and also saw your response to the person's pornographic avatar.
Perhaps another staff member bothered to take a screenshot, but I didn't.
But I think most people here trust me enough to know that I'm not lying when I say you responded with something along the lines of "I don't have a problem with the avatar. If we had more female members, maybe there would be a problem."
So don't go trying to pull this innocent stuff.
Whether it was only your intent to have a private porn section is irrelevant, and I think your track record here so far puts a big dent in your credibility.
I don't know all the details, but if DuffMan says you made a limited access section, I think I'll choose to believe his word over yours.
But it doesn't matter.
You broke the rules, and you allowed others to break the rules, and you got caught.
Own up to it like a man.

OK. Since no one has told us yes or no I too have registered to try and help out our board http://s6.invisionfree.com/FF_stuff and please hear me out. You are all correct in saying that it was our fault because we didn't do anything to stop what was violating the ToS but still you have to see this, we can't control people in our forums. You can even email the webmaster at the forum that was being attacked and they will "take our side" if you will in helping us get our board back. If you will not in fact give us a second chance please notify us so we can look at other means of trying to get our board back up such as VBulletin or IPB. Thank you for your time and please reconsider.

just create a new forum......

i really don't see the point in argueing

the only difficuly thing is getting your members back
and putting in all the codes again

but normally you have a few e-mails of members
so you can contact them to say the url of the new site

It isn't that simple. All of our work (And we did a lot of work as Schwarz mentioned our "head guy" failed two classes he was so busy with this.) is gone and a lot of that work won't be accessible again due to unplanned circumstances and why would we want to make another if our last one got closed don't you think that will make a sort of rift between us and invisionfree?

i always back up my header/footers

just incase i mess something up

keeping a list of emails of your members is a good thing to have for each admin

so if you do that getting back up isn't that hard

We've made a close-knit family that we wouldn't want to lose. And weeks worth of work would be wasted. There were also some very memorable threads and posts. For what reason can it (http://s6.invisionfree.com/FF_Stuff/)not be reopened?

If you expected your own members to say that, why didn't you just take action as an admin to do what you expected? exactly. :huh:
