Hey, just wondering if ROM Hacking and discussing it is allowed to be discussed on zetaboards forums. I understand providing download links etc to ROMs is forbidden, as it's illegal. But is it allowed to discuss tools to hack the ROMs to modify games (this, as far as I know, is not illegal). Comments? |

Can you tell me/us why it's prohibited to discuss rom hacking techniques and share tools for it? It's only illegal to supply actual rom downloads (and technically supplying rom hack patch downloads (not the rom) is legal). Roms are actually legal as well, as long as you also own the game cart as well. Now, it's true that most people don't own the games they play roms on, but that is their own problem if they find a rom on the internet and it can't be connected a board or ZB at all. My point here is that there's really no (legalistic) reason to prohibit the discussion of roms and even the act of rom hacking/patching, so long as actual, playable roms are not shared. |

The simple fact is, it's in the Terms you agreed to. Not all of the things on that list are illegal. All illegal things are prohibited, and additionally those things. It's better to prohibit them all then to have to police it and be held responsible if somebody went far enough to break the law. |

If you wanna play that game, then the points you specified are not clear enough to state that rom "modding" (since that's a more accurate term), is prohibited. The terms of service clearly need revised by someone who's not a strict nazi. a) hacking or cheating ONLINE (or internet; aka online again, since you need the online activity to go online to the internet... funny that right?). For a start, the rom in question, or any rom for that matter, is not online. I can throw my router into a bathtub and still play some pokemon red yeaaaaaah seaking. b) again, you highlight stuff that doesnt matter, warez and stuff. and you highlight "ROMS", well that's not clear at all. i already mentioned that linking to roms is not allowed (which i wont do, as it can be against the law if you dont own a hard copy of the game), but where does that mention light hearted discussion on rom-hacking (or as said above, modifying), since youre not really doing any damage or illegal activity. c) hacking material or information. really? its not like im programming an army of pikachu's to rob banks and steal people administrator passwords around zetaboards. CodyTZ use thunderbolt! ...really? Again, it's too strict and unclear. I did sign up to those terms, but what you don't understand is that I don't see anything specifically stating that rom modification and discussion is "prohibited". Yes it mentions roms, but that is most probably linking to and discussing illegal ways to play games on an emulator. Please revise these points and come back with a clear, and less arrogant response. For your information, I can read. And I am fully aware of the TOS. But why do you think I'm asking this question? Because it's not very well written. Thanks. Yes, some of what was emphasized was not relating to what you meant. (I also don't know of any online games on ROMs.) I will, however, offer my interpretation. Please note that this is my best-effort interpretation. Now, the ToS states that "A forum may not contain posts, uploads, links to, or send via email any Content that contains, promotes, gives instruction about, or provides prohibited Content," where prohibited content includes "Warez, Roms, CD-Keys, Cracks, Passwords, or Serial Numbers." (Those are all there because they're all listed in the same subpoint. I do realize we're only talking about one of them.) Now, you've mentioned that you're not linking to them, and I'm going to infer that you're also not uploading ROMs to your forum and sharing them that way, so that rules out "Content that contains ... or provides prohibited Content." And so that leaves us with ROM discussion, the part about which you are asking. Unfortunately, this is the part where it gets tricky. Also mentioned as being prohibited is "Content that ... promotes [or] gives instruction about ... prohibited Content" (which, as previously mentioned, includes ROMs). Now, I can see it being possible to run a completely neutral ROM discussion that does no promotion or instructing regarding ROMs, but I feel it would be very difficult to pull off. Note that this will makes it unlikely that a ToS-abiding discussion can occur regarding things such as specific ROMs or even things you can do with said ROMS (promoting). Given this, I'd say it's safest to avoid discussion of ROMs unless you can set up an environment that completely avoids content that is or could be confused with promotion or instruction. |
