But yeah, because it's a criminal offense, the girl (in this case, her parents because she is a minor) can choose to decide whether or not to press charges.

Charges are automatically brought, CJ. There is no choice. Its the same thing as child pornography, endangering the welfare of a child. No complaining victim is required.

Then it must be different if the girl is over the age of 16, correct? Because at that point she can choose whether or not to press charges, right?

Well, over 17 in Illinois. But yeah, if she's over the age of consent, statutory rape doesn't apply.

@UUU: The boy will be asked to pay child support. And yes, a court order most likely will be issued.

Ohh, I see what you're saying now. I get it.

The only thing that I keep thinking about is the fact that one of my old friends got pregnant, and I'm pretty sure she was 14 or 15. I don't remember her saying anything about any court stuff when I talked to her last.

Post of the year. To be honest, it all boils down to what the judge decides. he could say they're close in age and throw it out, he could sentence the guy with statutory rape. In the end nothing else matters besides what the ruling judge decides. Unless I'm mistaken then the parent's or a guardian do have to have a problem with them having sex since they're both under the age of consent.

My advice: The girl needs to take a pregnancy test and fast. If she is pregnant then she needs to establish paternity. (if she's having one night stands with a guy she doesn't even talk to, that doesn't say much about her, no offense) After that she needs to get a hold of DHS and/or DCF to get child support arrangements made.

In my school district, at the middle school there is a girl who is pregnant with her second child in 8th grade

Anyway, don't tell the parents. They will find out themselves eventually if she really ispregnant and you'll lose a friend if you tell the parents
